Terms of Service

These terms are a binding agreement between you and If You Ain't First (“we,” “us,” the site at ifyouaintfirst.com). By creating an account or using the service, you're agreeing to them. If you do not agree to these terms, please do not use the service.

1. The Service

If You Ain't First lets you create leaderboards, invite people to them, track scores, and receive AI-generated commentary about the standings. Some features are free; some require a paid subscription or a one-time purchase (see Billing below).

2. Your Account

You need an account to create or join boards. Keep your password to yourself — you're responsible for what happens under your login. You must be at least 13 years old to use the service. One person, one account; don't create accounts to evade limits or bans.

3. Your Content

Board names, entries, scores, display names — that's your content, and it stays yours. By posting it you give us a license to store, display, and process it as needed to run the service (including generating AI commentary about it). Don't post content that is illegal, infringing, or harassing. Good-natured competitive banter among participants who have chosen to join a board is part of the product; genuine harassment or abuse is not permitted.

4. The AI Commentary

The commentary and recaps on your boards are generated by AI and are provided for entertainment purposes only. They are written in a fictional persona and are not statements of fact about real people. AI-generated output may be inaccurate, exaggerated, or otherwise unreliable, and we make no representations about its accuracy. Board owners can adjust or reduce the tone in the board's voice settings. Do not rely on AI commentary for any purpose other than entertainment.

5. Acceptable Use

Don't abuse the service: no attempts to break, overload, or reverse-engineer it; no scraping other people's boards; no using it to spam, defraud, or harass; no automated account creation. We can suspend or terminate accounts that violate these terms.

6. Billing

Paid features include the Pro subscription (recurring, billed through Stripe) and one-time board passes. Prices are shown at checkout. Subscriptions renew automatically until you cancel; you can cancel anytime from the billing portal and you'll keep premium access until the end of the period you paid for. We may change prices going forward with notice — never retroactively for a period you've already paid.

7. Refunds

Purchases are generally final. If something goes wrong on our end — a duplicate charge, a billing error, or a service failure — contact us at hi@ifyouaintfirst.comand we'll make it right. Other refunds are issued at our discretion, except where a refund is required by applicable law.

If a payment is refunded, reversed, or disputed, the premium access associated with that payment is revoked. If you believe a charge is incorrect, please contact us before initiating a dispute with your card issuer — most billing issues can be resolved quickly by email.

8. Termination

You can stop using the service or delete your account whenever you like. We can suspend or terminate accounts that violate these terms or abuse the service. If we terminate your account without cause while you have an active paid period, we'll refund the unused portion.

9. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied. We don't guarantee the service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

11. Changes to These Terms

We may update these terms as the service evolves. If a change is material, we'll make it visible — updated date at the top, and notice in the product for anything significant. Continuing to use the service after a change means you accept it.
